DISCLAIMER

Payment, Terms and Release of Liability, CLIENT agrees to the following terms for services rendered by Pc & Mac Wizard Service:

Payment Terms:

Pc & Mac Wizard Service reserves the right to refuse services as well as to change fees and rates at any time without notice.

CLIENT agrees to pay Pc & Mac Wizard Service for all charges at the time of services.

Release of Liability:

CLIENT AGREES TO RELEASE AND HOLD HARMLESS PC & MAC WIZARD SERVICE FROM ANY AND ALL LIABILITY ASSOCIATED WITH THE PERFORMANCE OF SERVICES OR THE PROVISION OF PARTS AND ACKNOWLEDGES ALSO THAT PC &  MAC WIZARD SERVICE OFFERS NO EXPLICIT OR IMPLIED WARRANTY OR GUARANTEE ON SERVICES PERFORMED OR PARTS PROVIDED, OTHER THAN THE MANUFACTURER’S WARRANTY, FURTHERMORE:

 

1. CLIENT acknowledges that due to the nature of the services being performed, there is potential risk of damage or loss including, but not limited to, damage to Client’s home office, computer hardware, cabling, hubs, routers, switches, peripherals, accessories, and furniture, as well as potential risk of damage, corruption, or loss of computer software, applications, data, and data storage media.

2. CLIENT agrees to release and hold Pc & Mac Wizard Service harmless from all liability for damage or loss as well as any incidental or consequential material or financial damage or loss that may result from the actions of Pc & Mac Wizard Service, its technicians or service representatives.

3. CLIENT grants Pc & Mac Wizard Service, its technicians and service representatives, access and permission to physically disassemble any and all laptop systems, computer systems, components, networks, cabling, hubs, routers, switches, peripherals, and accessories.

4. CLIENT grants Pc & Mac Wizard Service, its technicians and service representatives access to security rights, and permission to open, view, and modify, edit, delete, or otherwise manipulate CLIENT’S computer software, applications, data, and data storage media including, but not limited to the computer’s Operating System, word processing, spreadsheets, databases, workflow, graphics, audio, video, system drivers and libraries, and any other type of software or data that may be contained on CLIENT’S computer, system or network.

5. CLIENT grants Pc & Mac Wizard Service, its technicians and service representatives, permission to physically access CLIENT’S home or office property where CLIENT’S computer system and/or network reside.

6. CLIENT grants Pc & Mac Wizard Service, its technicians and service representatives, permission to perform modifications to CLIENT’S home or office property for the purpose of installing or troubleshooting computer and/or networking hardware, cabling, hubs, routers, switches or peripherals. Modification may include such practices as drilling through or disassembling furniture, walls, floors, carpet, or trim, laying and removing cabling and devices including affixing cabling and devices to furniture, walls, floors, or trim, using nails, screws, staples, hangers, or plastic ties.

7. CLIENT grants Pc & Mac Wizard Service, its technicians and service representative, permission to download and/or install software on CLIENT’S computer and/or network, including but not limited to, virus scanners, diagnosis and repair utilities, drivers, libraries, and software requested to be installed by CLIENT.8. CLIENT grants Pc & Mac Wizard Service, its technicians and service representative, permission to install hardware in CLIENT’S computer and/or network, including but not limited to, LCD screens, glass, keyboard, track pads, memory chips, processor chips, cooling fans, batteries, hard drives, tape drives, storage devices, modem, motherboards,  audio and video cards, network interface cards, hubs, routers, switches, printers, scanners, cables, and other hardware requested to be installed by the CLIENT.

9. CLIENT agrees to release and hold Pc & Mac Wizard Service harmless from all liability for damage or loss that may result from the shipping company. If damage occurs to your laptop during shipment, you are required to keep the packing material for inspection and Pc & Mac Wizard Service must be notified within 3 days of receipt of the damaged package. All shipping is insured for the original purchase price of your laptop, not including upgrades, up to $2000, in the case of a loss or if the damage is greater than the replacement cost of your machine. Insurance claims require a proof of purchase (original receipt or credit card statement) before a reimbursement can be made. Insurance claims are approved by the shipping company. All packages containing laptops shipped from our facility require a signature from you or an authorized recipient upon delivery. If you wish not to require a signature upon delivery, you agree to release Pc & Mac Wizard Service from any liability for damages or loss discovered during or upon the return of your laptop. An electronic agreement to release Pc & Mac Wizard Service of liability will be required by you, the recipient, and will be kept in our records.

 

Pc & Mac Wizard Service strongly advises that CLIENT safeguards critical data by backing up said data prior to any services performed by Pc & Mac Wizard Service. Unless specifically requested and provided as a paid service by Pc & Mac Wizard Service, CLIENT is responsible for any backup, archiving, or protective storage as well as restoration if required, of CLIENT’S data. CLIENT must take back serviced equipment when services are completed or a $10 a day stocking fee will be applied for each day a [PC or Laptop] is in our possession or unpaid.  Pc & Mac Wizard Service is not responsible for items or electronic equipment [computers, laptops, netbooks, iPads, cell phones, printers, cables, chargers, motherboards, tower server, etc.] left over 7 days of job completion.  Any electronic equipment including but not limited to [computers, laptops, netbooks, iPads, cell phones, printers, cables, chargers, motherboards, tower server, etc.] left unpaid or unclaimed over 14 days will automatically become Pc & Mac Wizard Service property. An early termination Fee of ($350.00 USD) will be charge in the event a monthly plan is cancelled before the end of its term.  Pc & Mac Wizard Service will charge a 20% cancellation fee in the event a Client cancels a purchase order or estimate after is has been signed.  Pc & Mac Wizard Service has a No Refund Policy, once sale or services are completed and paid, the sale is final.  If a part becomes defective within 30 days of purchase, said client could get an exchange for the exact same part.  Pc & Mac Wizard Service is a provider of billable on site & in store computer repair services and does not offer or provide telephone technical support without a basic fee of $45 (Per 15 minutes and Per incident). Neither the signing of this agreement nor the performance of services by Pc & Mac Wizard Service implies availability of telephone technical support. This document constitutes the entire agreement between CLIENT and Pc & Mac Wizard Service. No other agreement whether verbal or written shall be in effect except if agreed to and authorized in writing.  Pc & Mac Wizard Service will never share, sell, lend or otherwise make any client information [Data] available to third parties without client’s consent, unless it is required by law for our company to do so.  We may occasionally contact our clients regarding our services or other IT service related information.

By reading this document, CLIENT indicates that he/she has read and understands, and agrees to the terms of this Payment Terms and Release of Liability form, which is kept on file at the offices of Pc & Mac Wizard Service.
